1. Purpose and Scope
BetaZen Infotech Private Limited is an IT services and technology company based in Kolkata, West Bengal, India, offering custom web and software development (including WordPress), mobile app development, AI/ML solutions, cloud and DevOps services, UI/UX design, digital marketing, WhatsApp marketing, and technology consulting. This Policy explains what constitutes acceptable and unacceptable use of our resources and is intended to protect our users, our systems, and third parties.
This Policy applies to:
• Our website and any subdomains, pages, and content hosted at betazeninfotech.com.
• Our digital and SaaS products, including subscription plans, demos, and documentation. We supply digital and subscription-based offerings only; we do not sell physical goods and there is no physical shipping.
• All services we deliver to clients, our online appointment booking (including paid consultations), our payments and checkout flow ("BetaZen Pay"), and the digital certificates we issue.
• Any accounts, application programming interfaces, dashboards, or communication channels made available to you.
We may update this Policy from time to time to reflect changes in law, technology, or our operations. Your continued use after any update constitutes acceptance of the revised Policy.
2. Definitions
For the purposes of this Policy:
• "Content" means any text, image, code, file, message, document, or other material that is uploaded, transmitted, stored, or displayed through our website, products, or services.
• "Services" means the IT and technology services, digital products, subscription plans, appointment booking, BetaZen Pay checkout, and digital certificate issuance provided by BetaZen Infotech.
• "User", "you" or "your" means any person or entity that accesses or uses our website, products, or services, whether or not registered.
• "User-Generated Content" means Content that you or other users submit, post, or transmit through our platforms.
• "Applicable Law" means the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, together with all rules and regulations made under them.
3. General Conduct
You must use our website, products, and services only for lawful purposes and in a manner that is consistent with this Policy, our Terms & Conditions, and Applicable Law.
You agree that you will:
• Provide accurate, current, and complete information when you register, subscribe, book an appointment, or make a payment through BetaZen Pay.
• Keep your account credentials confidential and take reasonable steps to secure your account and devices.
• Respect the rights, privacy, and safety of other users, our personnel, and third parties.
• Comply with any usage limits, fair-use conditions, or plan restrictions applicable to your subscription.
• Be responsible for all activity that occurs under your account.
You must not use our resources in any way that could damage, disable, overburden, or impair them, or interfere with any other party's use of them.
4. Prohibited Activities
You must not, and must not permit or encourage any third party to, engage in any of the following while using our website, products, or services:
• Illegal use of any kind, or any activity that violates Applicable Law or the rights of others.
• Infringing, misappropriating, or violating any intellectual property right, including copyright, trademark, patent, trade secret, or moral rights.
• Introducing, transmitting, or distributing any virus, worm, trojan, ransomware, malware, or other harmful or malicious code.
• Sending spam, unsolicited bulk or commercial messages, or any communication that violates applicable anti-spam or telecom regulations.
• Engaging in phishing, spoofing, identity theft, payment fraud, or any deceptive or fraudulent activity.
• Attempting to gain unauthorised access to any account, system, server, network, or data, or conducting security testing, penetration testing, or vulnerability scanning without our prior written consent.
• Scraping, crawling, harvesting, or extracting data through automated means, or using bots, spiders, or similar tools, except as expressly permitted by us in writing.
• Overloading, flooding, or disrupting our infrastructure, including through denial-of-service attacks, excessive requests, or circumventing rate limits.
• Reverse-engineering, decompiling, disassembling, copying, reselling, sublicensing, or creating derivative works from our software, source code, or products without our prior written permission.
• Uploading, posting, or transmitting Content that is unlawful, obscene, pornographic, hateful, defamatory, threatening, harassing, or otherwise objectionable.
• Violating the privacy or data-protection rights of any person, or collecting or processing personal data without a lawful basis and, where required, consent.
This list is illustrative and not exhaustive. We may treat any conduct that we reasonably consider harmful, abusive, or inconsistent with the spirit of this Policy as a prohibited activity.
5. Payments and BetaZen Pay
Where you make payments through our BetaZen Pay checkout flow, you must use only payment instruments that you are lawfully authorised to use. Payments are processed by third-party, PCI-DSS-compliant payment gateways that handle card, UPI, netbanking, and wallet data; BetaZen Infotech does not store full card numbers or CVV.
You must not:
• Use stolen, unauthorised, or fraudulent payment details.
• Initiate wrongful chargebacks or disputes, or attempt to evade or manipulate applicable fees, taxes, or currency conversion. Charges are primarily in Indian Rupees (INR); United States Dollars (USD) may apply for international clients, with GST charged as applicable.
• Interfere with, probe, or bypass the security of the payment gateway or checkout process.
Project fees, payment schedules (40% as an advance to commence work, 30% at the agreed mid-project milestone, and the remaining 30% before final delivery/handover), late-payment interest (1.5% per month), and related terms are governed by our Payment Policy and Service Agreement Policy. Refunds for eligible digital products, where available, are handled in accordance with our Refund Policy (refund window: 7 (seven) days; processing time: 7 to 10 business days).
6. User-Generated Content Standards
You are solely responsible for any User-Generated Content you submit, and you represent that you have all necessary rights to do so. By submitting Content, you confirm that it does not violate this Policy or Applicable Law.
User-Generated Content must not:
• Be false, misleading, defamatory, or deceptive.
• Infringe any intellectual property, privacy, publicity, or other right of any person.
• Contain obscene, indecent, hateful, discriminatory, or unlawful material.
• Contain malware, malicious links, or code intended to harm systems or users.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
We do not routinely pre-screen User-Generated Content, but we reserve the right to review, moderate, refuse, edit, or remove any Content that we reasonably believe violates this Policy or Applicable Law, without notice and at our sole discretion. Your Content is also subject to how we handle personal data under our Privacy Policy and Cookie Policy.
7. WhatsApp and Marketing Features
Where you use our WhatsApp marketing, digital marketing, or other messaging and outreach features, whether as a client of our services or through tools we provide, you must comply with all Applicable Law and with the terms, policies, and guidelines of the relevant platforms and providers, including WhatsApp and its business messaging rules.
In particular, you must:
• Send messages only to recipients who have provided valid consent or opt-in, where such consent is required.
• Honour opt-out and unsubscribe requests promptly.
• Avoid spam, unsolicited bulk messaging, and any content prohibited by the platform.
• Comply with applicable telecom, advertising, consumer-protection, and data-protection regulations in India.
You are responsible for the lawfulness of your recipient lists and message content. We may suspend or withdraw access to these features if we reasonably believe they are being misused, and any resulting penalties, account restrictions, or third-party actions are your responsibility.
8. Security and System Integrity
You must not take any action that compromises, or could compromise, the security, availability, or integrity of our systems or those of our users and third parties.
Without limiting the general prohibitions above, you must not:
• Attempt to circumvent, disable, or interfere with any security, authentication, or access-control feature.
• Use another user's account or credentials, or share your credentials in a manner that enables unauthorised access.
• Introduce automated processes that degrade performance or consume disproportionate resources.
• Access, tamper with, or use data, accounts, or systems that you are not authorised to access.
If you discover a security vulnerability, we encourage responsible disclosure. Please report it promptly to info@betazeninfotech.com and do not exploit, publicise, or share the vulnerability before we have had a reasonable opportunity to address it.
9. Monitoring and Enforcement
We do not undertake to monitor all use of our website, products, or services, and we are not obliged to do so. However, we reserve the right to monitor, review, and investigate use of our resources to detect and prevent violations of this Policy, protect our systems and users, and comply with Applicable Law and lawful requests from authorities.
Where we detect or reasonably suspect a violation, we may take any action we consider appropriate, including preserving relevant records and cooperating with law-enforcement or regulatory authorities. Any monitoring and processing of personal data is carried out in accordance with our Privacy Policy and Applicable Law.
10. Consequences of Violations
If you violate this Policy, or if we reasonably believe that you have done so, we may take one or more of the following actions, in our sole discretion and without liability to you:
• Issue a warning and require you to remedy the violation.
• Restrict, suspend, or throttle your access to the website, products, or services.
• Remove or disable access to any offending Content.
• Suspend or terminate your account, subscription, or engagement, with or without notice, in accordance with our Cancellation Policy and Service Agreement Policy.
• Withhold or forfeit refunds where the termination results from your breach, subject to our Refund Policy.
• Pursue legal remedies, including claims for damages and injunctive relief.
• Report the matter to the relevant law-enforcement, regulatory, or governmental authorities.
The availability of any remedy does not limit our right to pursue any other remedy available under this Policy, our Terms & Conditions, or Applicable Law. Our liability in connection with the Services remains subject to the liability limitations in our Terms & Conditions (under which our total aggregate liability is limited to the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim).
11. Reporting Violations
If you become aware of any use of our website, products, or services that violates this Policy, or of any illegal, harmful, or infringing Content or activity, please report it to us promptly.

12. Relationship with Other Policies
This Policy forms part of the agreement between you and BetaZen Infotech and must be read together with our other policies, including the Terms & Conditions, Service Agreement Policy, Privacy Policy, Cookie Policy, Payment Policy, Refund Policy, Cancellation Policy, SLA & Support Policy, and Disclaimer.
If there is any conflict between this Policy and our Terms & Conditions on a matter of acceptable use, the Terms & Conditions prevail unless expressly stated otherwise. Support and service levels are addressed in our SLA & Support Policy, and our standard support hours (Monday to Saturday, 10:00 AM to 7:00 PM IST) and holiday exclusions (excluding national and state public holidays) apply as set out there. Capitalised terms not defined in this Policy have the meaning given in our Terms & Conditions.
13. Governing Law and Dispute Resolution
This Policy is governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Our handling of personal data is further governed by the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 (and rules thereunder).
Any dispute, controversy, or claim arising out of or relating to this Policy or its subject matter shall first be attempted to be resolved amicably between the parties. Failing amicable resolution, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration at Kolkata, West Bengal. The arbitration shall be conducted in English by a sole arbitrator, and the award shall be final and binding.
Subject to the arbitration provisions above, the courts at Kolkata, West Bengal, India shall have exclusive jurisdiction over any matter arising from or relating to this Policy.
