1. Scope and Applicability
This Cancellation Policy governs the cancellation of engagements between you and BetaZen Infotech Private Limited (CIN: U62099WB2023PTC265741), a private limited company incorporated in India, with its registered and operating office in Kolkata, West Bengal, India.
This policy applies to:
• Custom web and software development projects (including WordPress), mobile app development, AI/ML, cloud/DevOps, UI/UX design, digital marketing, WhatsApp marketing, and technology consulting;
• Digital and SaaS products, including subscription plans, demos, and documentation;
• Paid appointments and consultations booked through our online booking system; and
• Payments processed through our checkout flow ("BetaZen Pay").
We deal only in digital and service-based offerings. We do not sell physical goods and do not undertake any physical shipping. Where a specific written agreement, statement of work, order form, or subscription plan sets out cancellation terms that differ from this policy, those specific terms will prevail to the extent of any conflict.
2. Definitions
In this policy:
• "Project" means any custom development, design, marketing, or consulting engagement performed on a fixed-scope or milestone basis;
• "Milestone" means a defined stage of a Project as described in the applicable statement of work or agreement;
• "Subscription" means recurring, plan-based access to a digital or SaaS product;
• "Booking" means a paid or unpaid appointment or consultation reserved through our online booking system;
• "Billing Period" means the monthly, annual, or other recurring cycle for which a Subscription fee is charged;
• "Advance" means any amount paid by you before or during a Project, including the initial payment under the payment schedule; and
• "Business Day" means a day (other than a Saturday, Sunday, or public holiday in Kolkata, West Bengal) on which banks are open for business.
3. How to Request a Cancellation
All cancellation requests must be made in writing and sent to us at info@betazeninfotech.com. A request is effective only when we have received it and issued an acknowledgement.
To help us process your request promptly, please include:
• Your name and registered contact details;
• The service, Subscription, Project, or Booking concerned;
• The invoice, order, or booking reference, if any; and
• The reason for cancellation (optional, but helpful).
A verbal, telephone, or chat request is not sufficient on its own. The date of cancellation is the date on which we receive a valid written request, subject to any notice period specified in this policy or your agreement.
4. Cancellation of Custom Projects by You
You may cancel an ongoing custom Project at any time by sending written notice to info@betazeninfotech.com. Because Project work is bespoke and resources are allocated in advance, the following applies on cancellation:
• All Milestones that have been completed, and all work in progress up to the date of cancellation, remain billable and are payable in full;
• Any Advance already paid will be adjusted against the value of the work performed and any non-recoverable third-party costs already incurred on your behalf;
• If the value of work performed exceeds the Advance, we will raise a final invoice for the balance, payable in accordance with our Payment Policy; and
• Whether any part of an Advance is refundable, and on what basis, is governed by our Refund Policy.
Our standard project payment schedule is 40% as an advance to commence work, 30% at the agreed mid-project milestone, and the remaining 30% before final delivery/handover. Amounts already invoiced or due at the point of cancellation remain payable, and late payments may attract interest of 1.5% per month as set out in our Payment Policy. GST at 18%, or as otherwise applicable, will be charged on all payable amounts.
5. Cancellation or Suspension by BetaZen Infotech
We may suspend or cancel a Project, Subscription, or service, in whole or in part, with written notice, in circumstances including:
• Non-payment of any invoice or fee by its due date;
• Material breach of the applicable agreement, our Acceptable Use Policy, or our Service Agreement Policy;
• Provision of false, misleading, or incomplete information by you;
• Use of our services for unlawful, fraudulent, or abusive purposes; or
• Any legal, regulatory, or risk-related reason that reasonably requires us to do so.
Where the cause is capable of being remedied, we will, where practicable, give you a reasonable opportunity to remedy it before cancelling. On a cancellation by us for cause, all amounts for work performed and services rendered up to the effective date remain payable, and refunds (if any) are governed by our Refund Policy. Nothing in this section limits any other right or remedy available to us under law or the applicable agreement.
6. Cancellation of Subscriptions and Digital Products
You may cancel a Subscription at any time by submitting a written request to info@betazeninfotech.com or, where available, through your account settings. On cancellation of a Subscription:
• The cancellation takes effect at the end of your then-current Billing Period;
• Your access to the product and its features continues until the end of that Billing Period; and
• The Subscription will not renew for any subsequent Billing Period.
We do not provide partial-period or pro-rata refunds for the unused portion of a Billing Period, except where the product is found to be faulty or not as described, in which case the matter will be handled under our Refund Policy. Our standard refund window for eligible digital products is 7 (seven) days from the date of purchase. Approved refunds are processed within 7 to 10 business days.
7. Cancellation and Rescheduling of Appointments and Consultations
If you have booked an appointment or paid consultation through our online booking system, you may cancel or reschedule it by giving us prior notice in writing to info@betazeninfotech.com or through your booking confirmation, subject to the following:
• To cancel or reschedule without charge, please give us notice at least twenty-four (24) hours before the scheduled start time;
• Where a booking fee has been paid and you cancel within the free-cancellation window, the fee will be refunded or credited toward a rescheduled session, as handled under our Refund Policy;
• Where you cancel with less than twenty-four (24) hours' notice, any paid booking fee may be treated as non-refundable to cover the reserved slot and preparation time; and
• Rescheduling is subject to availability, and a booking may be rescheduled a reasonable number of times.
Refund processing for any eligible booking fee follows our standard timeline of 7 to 10 business days.
8. No-Shows
A "no-show" occurs where you fail to attend a scheduled appointment or consultation without cancelling or rescheduling in advance in accordance with Section 7.
In the case of a no-show:
• Any paid booking fee is treated as forfeited and is non-refundable; and
• We are under no obligation to reschedule the session without a fresh booking.
We understand that genuine emergencies occur. If you are affected by an unavoidable emergency, please contact us at info@betazeninfotech.com as soon as reasonably possible, and we will consider your circumstances on a good-faith basis.
9. Effect of Cancellation
On the effective date of any cancellation:
• We will raise a final invoice for all completed Milestones, work in progress, services rendered, and any recoverable third-party costs, payable in accordance with our Payment Policy;
• Access to the relevant service, Subscription, or product will cease at the end of the applicable Billing Period or on the effective date, as set out above;
• Subject to full settlement of all amounts due, we will make available to you a reasonable handover of deliverables and work product completed and paid for up to the cancellation date;
• Data associated with your account or Project will be retained, returned, or deleted in accordance with our Privacy Policy and applicable law; and
• Any licences or access rights granted to you that are conditional on payment or continued subscription will terminate accordingly.
We will not release final source code, deliverables, or access credentials while any undisputed amount remains outstanding. Digital certificates already issued to you before cancellation remain valid unless revoked for cause.
10. Payments, Refunds, and Taxes
All fees are quoted and payable primarily in Indian Rupees (INR); United States Dollars (USD) may apply for international clients. Goods and Services Tax (GST) at 18%, or as otherwise applicable, is charged on all invoices.
Payments are processed through our checkout flow ("BetaZen Pay") using third-party, PCI-DSS-compliant payment gateways that handle card, UPI, netbanking, and wallet transactions. We do not store your full card number or CVV.
Whether, and to what extent, any amount is refundable on cancellation is determined by our Refund Policy, and payment obligations and timelines are governed by our Payment Policy. Approved refunds are made to the original payment method within 7 to 10 business days. This Cancellation Policy should be read together with both of those policies.
11. Governing Law and Dispute Resolution
This Cancellation Policy is governed by and construed in accordance with the laws of India.
Any dispute, controversy, or claim arising out of or in connection with this policy or a cancellation shall first be attempted to be resolved amicably between the parties. Failing amicable resolution, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed in accordance with that Act. The seat and venue of arbitration shall be Kolkata, West Bengal, and the language of arbitration shall be English.
Subject to the arbitration provisions above, the courts at Kolkata, West Bengal, India shall have exclusive jurisdiction over any matter arising from or relating to this policy.
12. Changes to This Policy
We may update or amend this Cancellation Policy from time to time to reflect changes in our services, business practices, or applicable law.
The revised policy takes effect when published on our website at betazeninfotech.com. Where a change is material, we will take reasonable steps to notify you, for example by email or a notice on our website. Your continued use of our services or website after a change takes effect constitutes your acceptance of the updated policy. We encourage you to review this policy periodically.
